When Eileen lost her father very unexpectedly in a tragic accident, she had no idea just how complicated dealing with his estate would be. She and her SJP Partner Sean reveal the extraordinary journey to putting a whole family back on solid financial ground

But following a tragic family accident, the true state of the family’s finances, estates and inheritances came to light. It was a story of forgotten Wills, missing paperwork, and incomplete estates stretching back generations.

Here Eileen and Sean share the moving story of their journey to a secure financial future, for the whole family.

Eileen is a very practical woman. A mother of two, with a demanding and responsible role with a major pharmaceutical company, she can take most things that life throws at her. But even Eileen couldn’t have foreseen the life events that she would be facing, just eighteen months after meeting her SJP adviser, Sean.

In 2019, Eileen was newly separated from her partner, and looking for some straightforward mortgage advice. She was, she admits, a little nervous when she first met Sean through a mutual friend.

“Living on my own for the first time in my life was quite a culture shock,” says Eileen. “I’d been married for so long, and I wanted to take stock of my own personal finances, so I could feel confident at the start of this new chapter of my life.” And the first step was finding a mortgage for her new home.

Right from the start, Eileen and Sean struck up a rapport. “I went in to the meeting feeling nervous, and came out empowered,” says Eileen. “Feeling that I’d found someone who knew what I needed – and would make sure I got it.”

Over the next eighteen months with Sean’s help, Eileen found the right mortgage, opened an ISA, sorted out her pension and reconfigured her personal finances for her new life.

In 2022, Eileen’s 77-year old father suffered a fatal accident. Eileen, who was with him at the time it happened, was absolutely devastated. But when she and Sean began to look into her father’s finances to deal with probate and inheritance, they had no idea what was waiting for them.

“Dad was about as far removed from having his finances organised as it’s possible to get. Almost none of the paperwork – if we had it – was up to date. It was a mess,” says Eileen.

Eileen thought that her late father might have made a Will many years earlier, which could have been placed in a safety deposit box. “However, I was denied access to the box until I had probate – but I couldn’t get probate until I had access to what was in the box – including any existing Will,” explains Eileen. “When we finally found his Will, we discovered he’d left his estate to his second wife, not to my daughters, as he had said.“

And there was a further Catch-22.

 

Another incomplete estate in the family

The story didn’t end with one generation. “The deeper we dug,” says Eileen, “the more entangled things became. “ She discovered paperwork suggesting that her grandmother hadn’t left a Will when she died over twenty years before, so her estate also appeared to be incomplete.

In order to wind up her father’s affairs, Eileen first needed to complete her grandmother’s. It was an enormous logistical task, at a very difficult time. “I’ve never felt so out of control in my life,” Eileen says, “as I did that first year after losing dad.”

More than just advice

Diagnosed with post-traumatic stress disorder, Eileen was signed off work for six weeks for counselling.

“Sean could see that I was struggling,” she says. “And he simply said "Leave it all with me. I can deal with that paperwork and contact the insurance companies, if you give me authority.”

“There was no way I was going to leave Eileen to tackle this on her own, “Sean says. “My job was to give her support and a steer in the right direction.“

“I reached out to my contacts in probate, solicitors that I knew personally, called in favours, “says Sean. “So I could fast track the process as smoothly as possible. I sat in on meetings with solicitors as her friend, as well as her financial adviser,”. “He was my wingman,” says Eileen simply. “Sean helped pick up the pieces when I couldn’t.”

Sean helped to prioritise which parts of her late father’s affairs needed immediate action, and which could wait, taking a weight off Eileen’s shoulders so she could recover.

"Finances are a family affair"

Even today, the estates and the inheritances are still not finalised, but despite everything that’s happened “the one thing I haven’t been worried about is my financial future.“

“My personal finances are all sorted, and Sean and I now know more than we ever wanted to about executing an estate,” she smiles, adding that for her, finances are “a family affair.”

“Mum’s been talking to Sean to make sure her financial affairs are completely up-to-date, and that we have access to important documents like her Will. So that when the time comes, me and my two daughters aren’t left in another difficult situation.”

“To date, Sean’s arranged a mortgage for my daughter, and he’s helping my mum, my cousin, even my ex-partner. I’m practically one of the family’” Sean laughs. “But I still haven’t been invited round for Sunday lunch!”
